** Everyone that participates in a Little Princess Spa Mobile Fairy service or activity, must sign a valid waiver. Those under 18 must have it completed and signed\u00a0 by a parent, legal guardian, or someone with power of attorney.<\/p>

<\/p>

Hold Harmless Clause:<\/p>

ENTER Little Princess Spa MOBILE FAIRY AUSTIN AT YOUR OWN RISK. Whether you signed the liability waiver or not, by being within the premises of our set-up, partaking in our activities and services, you assume all risk and liability. The business, affiliates, owners, employees, third party, independent contractors and customers are NOT RESPONSIBLE for injuries, accidents, slip & falls, choking, allergies, missing child, kidnap and or death. YOU knowingly and freely assume all such risks both known and unknown, even if arising from the negligence of the releasees and\/or others. By participating, you agree to adhere to this notice and assume all liabilities & responsibilities for yourself, your guest(s), minor children\/ ward(s) including all participants and non- participants. Non-participants are any and all persons who are in and\/or around the premises but not taking part in spa services and activities.<\/p>

LITTLE PRINCESS SPA MOBILE FAIRY SERVICES ARE NOT PERFORMED BY A LICENSED COSMETOLOGIST AND IS FOR ENTERTAINMENT PURPOSES ONLY. We do not use powered equipment, or hot tools.<\/p>

Little Princess Spa Mobile Fairy staff are trained entertainment professionals and will work to ensure that you and your guests are treated in the most respectable manner and in a safe environment.<\/p>

Allergies:<\/p>

We will attempt to use products that are considered safe for children however, we cannot guarantee that there will not be an allergic reaction to products being used for skin, hair, and nails. Unfortunately, skin damage or minor allergic reactions can result from these kinds of activities. Little Princess Spa Mobile Fairy is not responsible for any allergic reaction due to any services, activities, costumes or consuming any food, candy and beverage before, during or after the party, event, appointment, pop-up or camp. Little Princess Spa Mobile Fairy is not responsible for any allergic reaction caused by our party favors cosmetics which includes nail polish, lip gloss, lipstick, eye shadow and nail sticker (or bath bombs), or to any party favors or anything given from Little Princess SpaMobile Fairy to any child.<\/p>

\u00a0It is the responsibility of the guests or parent guardian to inform Little Princess Spa Mobile Fairy staff of allergies or any dietary restrictions.<\/p>

Injury\/Sickness:<\/p>

Little Princess Spa Mobile Fairy is not responsible for any slip or fall accidents or any accidents in general. Little Princess Spa Mobile Fairy is not responsible for any transmitted diseases, viruses, head lice and\/or bacteria.<\/p>

Lost Child\/Abduction:<\/p>

Little Princess Spa Mobile Fairy is not responsible for making sure your child gets picked up and dropped off by a parent or legal guardian. Little Princess Spa Mobile Fairy will not be responsible for any missing or abducted child. Little Princess Spa Mobile Fairy hereby informs you that we not liable for any of the following scenarios: a child who has been wrongfully taken by a nonfamily perpetrator through the use of physical force, persuasion, or threat of bodily harm; A runaway child, that voluntarily exits the premises for any reason and cannot be found thereafter. This would include any child 17 years of age or younger.\u00a0 A non-authorized member of the child\u2019s family, or someone acting on behalf of a family member, takes or fails to return a child.<\/p>

BY SIGNING THIS WAIVER YOU ARE AGREEING TO:<\/p>

In consideration of voluntarily participating in any parties or programs by Little Princess Spa Mobile Fairy, the undersigned, on his or her own behalf and on behalf of the minor identified acknowledges, appreciates and agrees that:<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 1) Services can be hazardous and dangerous. I understand that these activities can result in serious injury to the person or child. I assume any and all risk and damage or injury while on the Little Princess Spa Mobile Fairy\u00a0 premises.<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 2) I am aware of the risk, hazards and danger of personal injury, allergic reactions, choking, disability and\/or death as a result of participation at Little Princess Spa Mobile Fairy Activities.<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 3) I have read a copy of the rules of the spa and understand that it is my responsibility to ask questions about them if necessary. I also understand, it is my responsibility to ensure my child(ren) understands the rules. It is my responsibility to monitor my child(ren) and my own activities. I will bring any observation of the rules being broken to the attention of a Little Princess Spa Mobile Fairy staff member. I certify that I and\/or my child(ren) are in good health and that I and\/or my child(ren) have no physical limitations, which would preclude safe participation at Little Princess Spa Mobile Fairy.<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 4) I am aware that Little Princess Spa Mobile Fairy and its employees are not responsible for managing who picks up a child, and\/ or who a child leaves the party, event, day spa, class, or camp with. It is my duty or that of the parents \/ adults hosting the party or event, to supervise the children exiting the premises. In any case of child abduction or run-away child Little Princess Spa Mobile Fairy will not be held liable.<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 5) My child(ren)\u2019s participation in activities at Little Princess Spa Mobile Fairy is strictly voluntary.<\/p>

\u2756\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 6) It is not Little Princess Spas Mobile Fairy\u2019s employees, contractors, or representative\u2019s responsibility to care for or ensure that my child(ren) are not engaging in activities that could lead to a potential harm to themselves, harm to others, or to damage or destruction of property in the hosts\u2019 home or event space.<\/p>

<\/p>

I, the undersigned, parent\/ guardian assume all risks and hazards incidental to participating in the activity and hereby waive, release, absolve, indemnify and agree to protect, defend and hold harmless Little Princess Spa Mobile Fairy, owners, staff and participants for any claim arising out of any injury to myself\/ child to the fullest extent allowed by law. I, the undersigned parent\/ guardian of the participant, am fully aware of the potential dangers and risk inherent in this activity, including allergies, physical injury, death or other consequences that may arise or result directly or indirectly from participation in all salon and spa services and activities. If any provision of this clause is held unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then any such provision shall be deemed severable from this clause and shall not after the validity and enforceability of the remaining provisions.<\/p>

Minor (Child) Photo Release Form:<\/p>

I, the parent or legal guardian of the child\/children mentioned above grant Little Princess Spa Mobile Fairy my permission to use photographs taken during this event for any legal use, including but not limited to: publicity, social media content, copyright purposes, illustrations, advertising and web content. Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use.<\/p>

Consent to receive marketing:<\/p>

I consent to receive calls, emails, and texts from any and all dba Little Princess Spa Mobile Fairy<\/p>

locations with special offers, advertising and telemarketing messages.<\/p>

Precautionary COVID-19, Coronavirus Liability Release Form<\/p>

<\/p>

Due to the 2020 outbreak of the novel COVID-19 (Coronavirus), Little Princess Spa Mobile Fairy is taking extra precaution with the intake of each client, health history review, as well as sanitations and disinfecting practices.<\/p>

<\/p>

I affirm that I and\/or the child, as well as all households\u2019 members, have not been diagnosed with COVID-19 (Coronavirus) within the last 14 days. I affirm that I and\/or child, as well as household members, have not knowingly been exposed to anyone diagnosed with COVID-19 (Coronavirus) within the last 14 days.<\/p>

<\/p>

I understand that Little Princess Spa Mobile Fairy\u00a0 and its owners, agents, employees, officers, directors, trustees, binding heirs, executors, administrators, assignees, and all other persons or entities acting on its behalf cannot be held liable for any exposure to the COVID-19 (Coronavirus) or any other contagion caused by misinformation on this form or the health history provided by each client.<\/p>

I understand that Little Princess Spa Mobile Fairy\u00a0 will NOT be liable if I and\/or child fall ill with the COVID-19 (Coronavirus); either before, during or after coming to Little Princess Spa Mobile fairy\u00a0 facilities. By signing below, I agree to each above statement and release the employees and Little Princess Spa Mobile Fairy from any and all liability for the unintentional exposures or harm due to COVID-19 (Coronavirus).<\/p>

<\/p>

Little Princess Spa Mobile Fairy and employees of this facility agree that they abide by the same standards and affirm the same. Little Princess Spa Mobile Fairy also affirms that we have improved and expanded our sanitation protocols to more thoroughly fight the spread of COVID-19 (Coronavirus) and other communicable conditions.<\/p>

Final Remarks<\/p>

I hereby certify I am over 18 years of age; I have carefully read the foregoing covenants, I hereby release, waive and forever discharge and covenant not to sue Little Princess Spa Mobile Fairy and its owners, agents, employees, officers, directors, trustees, binding heirs, executors, administrators, assignees, and all other persons or entities acting on its behalf, from any and all claims, actions, damages, liability, cost or expense including attorney fees which are related to or arise out of or in any way connected to my child(ren) participation or use of the set up facility including those that may arise out of the negligence of other participants or visitors. I acknowledge that I understand and agree to all of the above terms and conditions. Prior to signing this agreement, I have had the ability\/opportunity to ask any questions to a LPS coordinator or representative and I am aware that by signing this waiver I am assuming all risks and potential injury while on the premises. Lastly, I expressly represent that I have the authority, expressed or implied, to bring said child(ren) to Little Princess Spa Mobile Fairy prior to signing this agreement and I am assuming all risks and potential injury while on Little Princess Spa Mobile Fairy premises\/activities.<\/p>

By signing below, I and\/or child, agree to each above rule and will comply with the rules. I will bring any observation of the rules being broken to the attention of a Little Princess Spa Mobile Fairy staff member. This waiver once signed\/ dated will apply to any date and time (past, present, future) you enter our facility even if you did not update your current\/past waiver to a future\/current date or the date you are attending. It will serve as an always and permanent waiver of Liability- Release Form- Indemnification Agreement.<\/p>

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t
